This is a great course introducing influential English legal system, its history, constitutional background, and institutions. I have visited UK for a few times, this course reminds me of the exciting journey and unforgettable experience.
The history part is the most interesting to me: William the Conquer, King Henry II and Magna Carta, it’s amazing that those historic events actually led to the development of civilization. The history explained itself why British constitutions is uncodified and why Parliamentary Sovereignty is one of the fundamental principles underpinning it.
The course throughly introduces the court system, its hierarchy, the responsibility of each court, and rule of setting “binding precedents”. Besides courts, how tribunals and alternative dispute resolutions function: mediation, conciliation, arbitration… well, see if you can tell the subtle difference.
Almost half of the course elaborates the 4 principal sources of English law: Statutes / Acts of Parliament, Common Law, European Union Law and European Convention on Human Rights; the relationship between UK an EU, and the impact of EU law on UK law.
There is no doubt that the common law of England and Wales is one of the major global legal traditions. Law is a living thing, it evolves as modern society develops.
